- When you are stopped by the police or brought in for questioning,
you have the right to remain silent. While Louisiana law does require you to identify yourself to the police, you do not have to answer any questions about what you are doing, where you are going, where you have just been, where you live, etc. You also do not have to discuss your immigration status with law enforcement or immigration officials. If you wish to exercise your right to remain silent—as is strongly recommended—you should express this calmly to the officer. Remember, anything you say can and will be used against you in future legal proceedings. Even if you are innocent and simply want to explain yourself, you may accidentally say something that could later be used against you in court. It is always in your best interests to remain silent until you have a chance to speak to a lawyer.
- You have the right to be free from unreasonable search and seizure, meaning you do not have to consent to a search of your home, vehicle, or belongings without a signed search warrant. However, law enforcement officials are legally allowed to search your person by conducting a “pat down” if they have reason to believe you may be carrying a weapon. You should state out loud that you do not consent to a search of your personal items. Even if this does not stop the officer from searching your things, a timely objection to the search before or while it occurs can protect you in future legal proceedings. For example, illegally obtained evidence will almost certainly be ruled impermissible by the court.
- If you are arrested by law enforcement,
you have the right to an attorney. If you cannot afford an attorney, one will be appointed to you by the court. You do not have to, nor is it recommended that you speak to police officers, detectives, prosecutors, or other law enforcement officials until you have first spoken to a lawyer.
